Users of the ABGR and/or NABERS site are entitled to expect that any information as a result of that use will be
treated within the terms of the New South Wales public sector privacy responsibilities and obligations.
The New South Wales public sector privacy practices are regulated by the
Privacy and Personal Information
Protection Act 1998.

Information collected from web browsing?
When you look at the pages on the ABGR and/or NABERS site, our computers automatically record information that
identifies, for each page accessed:
- the IP (Internet Protocol) address of the machine which has accessed it;
- your top-level domain name (for example .com, .gov, .au, .uk etc.);
- the address of your server;
- the date and time you visited the website;
- the page or download document you are attempting to view;
- whether our website successfully displayed the page or document;
- the previous site visited; and
- the type of browser and operating system you have used.
Cookies are not used from the ABGR and/or NABERS site to collect information.
How do we use information collected?
Information collected during each visit is collected and analysed with similar logged information and published in
reports in order for DEUS to identify patterns of usage of the site. This information assists us to improve the
site and the services offered on it.
DEUS will not disclose or publish information that identifies individual machines, or potentially
identifies sub-groupings of addresses, without consent or otherwise in accordance with the information
protection principles under the
Privacy and Personal Information Protection Act 1998.
What exceptions are there to this rule?
DEUS will collect, use and disclose more extensive information than stated above, in the following circumstances:
- unauthorised attempts to access files which are not published on DEUS' pages;
- unauthorised tampering or interference with files published on DEUS' site;
- unauthorised attempts to index the contents of DEUS' site by other sites;
- attempts to intercept messages of other users of DEUS' site;
- communications which are defamatory, abusive, vilify individuals or groups or which give rise to a suspicion that an offence is being committed; and
- attempts to otherwise compromise the security of the web server, breach the laws of the State of New South Wales or Commonwealth of Australia, or interfere with the social use of the ABGR and/or NABERS site by other users.
DEUS reserves the right to make disclosures to relevant authorities where the use of the ABGR and/or NABERS site
raises a suspicion that an offence is being, or has been, committed.
In the event of an investigation, DEUS will provide access to data to any law enforcement agency that may exercise
a warrant to inspect our logs.
Security and Personal information stored
DEUS has taken reasonable steps to protect information collected and to ensure it is stored in an appropriately
secure format.
Under the
Privacy and Personal Information Protection Act 1998 you have the right to access personal information
that DEUS hold about you, such as your address and phone number(s).
DEUS is committed to ensuring the information held is accurate, complete and up-to-date, so we encourage you to
advise us if any details of the information stored has changed. Should you feel any information is inaccurate,
please contact us and we will correct the information.
Retention - we will retain the information you have provided for a period that is appropriate for the purpose
for which it was provided. Your information will be archived and disposed of in accordance with DEUS' records management policies, legislative requirements and guidelines based on the
State Records Act 1998.
Information provided in Feedback?
DEUS provides a feedback facility on these sites to allow users to provide input into the future development of
the site and to comment on the provision of service by DEUS.
The provision of personal details on feedback is optional, however if a reply is required then a contact email
address should be left. We will not add your email address or name to any mailing list.
DEUS may publish aggregated information about feedback on the site, to the extent that it does not identify or
cannot be used to identify individual users.
Who else has access to information within DEUS?
DEUS captures this information via a third party Internet Service Provider - Connect.com. Access to the raw data is
restricted to a limited number of authorised officers on behalf of the Department of Energy Utilities and
Sustainability, for the purpose of analysis and to report on the success and inadequacies of the site.
The authorised officers who can access this data are the members of the Information, Communication & Technology
business unit.

Will this policy be updated over time?
Due to the developing nature of privacy principles for online communication, this policy may be modified or expanded
in light of new developments or issues that may arise from time to time. The amended policy will be posted to
this site and will operate from the time it is posted.
